WELCOME UNDOCUMENTED STUDENTS
Eligibility Requirements Written in English
Under AB 540 legislation, students who meet the following requirements may be exempt from paying nonresident tuition: enrolled at California public colleges and universities after January 1, 2002, attended a high school in California for three or more years, and graduated from a California high school (or equivalent). Undergraduate, graduate, and professional students are eligible to apply for this exemption.
Background Information:
Section One:
- There are high school students who have attended elementary and middle schools in this state for most of their lives and who are likely to continue their education in California, but are precluded from obtaining an affordable college education because they are required to pay nonresident tuition fees.
- These students have already proven their academic eligibility and merit by being accepted into our state’s colleges and universities.
- A fair tuition policy for all high school students in California ensures access to our state’s collective productivity and economic growth.
Section Two:
A student who meets all of the following requirements shall be exempt from paying nonresident tuition at the California State University, University of California and the California Community Colleges:
- High school attendance in California for three or more years.
- Graduation from a California high school or attainment of the equivalent thereof.
- Registration as an entering student, or current enrollment at an accredited higher education institution in California.
- Filing an affidavit stating the student has filed, or will file an application to legalize his or her immigration status as soon as he or she is eligible to do so.

Ley que favorece a los estudiantes que no son residentes para poder asistir a la universidad!!
Desde el 1º de enero del año 2002, la ley AB 540, permite que todos los estudiantes (menos los extranjeros que no sean inmigrantes) que cumplan con los siguientes requisitos, asistan a las universidades públicas del estado de California, que son: los Colegios Comunitarios de California (CCC), las Universidades de California (UC) y las Universidades Estatales de California (CSU).
Requisitos:
- El estudiante tiene que haber asistido a una High School (pública o privada), al menos durante tres años.
- El estudiante tiene que haberse graduado de una High School de California, o haber terminado el equivalente a esos estudios (por ejemplo, haber aprobado el GED o el Examen de Graduación de la Escuela Secundaria de California).
- El estudiante tiene que someter una petición para la excepción con la universidad, incluyendo una declaración legal firmada, en la cual afirma haber cumplido con todos los requisitos pertinentes.
- Los estudiantes que completen 3 años en una escuela de adultos y/o obtengan su GED podrían calificar para AB 540 si el colegio comunitario al que desean asistir lo considera equivalente a la High School.
- Los alumnos no residentes que cumplan con estos requisitos, podrán pagar las mismas cuotas que los residentes; sin embargo no podrán ser considerados dentro de la categoría de “residentes” de California.
- Los alumnos no inmigrantes (por ejemplo quienes tienen una visa “F” de estudiante, o la visa “B” de visitante, etc.), no califican para esta Ley.
- La Ley AB 540 no ofrece ayuda financiera estatal o federal para los estudiantes no residentes.
